A continuation of the shariah intelligence series and the topic of discussion is ISTISHAB – LEGAL PRESUMPTION or ACCEPTANCE OF THE STATUS QUO. Istishab is a secondary source of ruling as agreed by majority of scholars. It is a set of legal assumptions that sets the foundational ruling for everything in Islam. It is a judgement or ruling to the effect that a state of affairs which existed at an earlier time continues to exist now in the absence of evidence to the contrary. It set assumptions of continuity on matters of purity, prioritization, importance, and matters of significance of truth.
